Terms of Service

1. Agreement to Terms

By creating an account or using GoalQuest, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our service. These terms constitute a legally binding agreement between you and Jordan Saker.

2. Eligibility

• Parent/Guardian Accounts: You must be at least 18 years old and a parent or legal guardian to create a GoalQuest account.
• Child Profiles: Children's profiles may only be created by their parent or legal guardian. By creating a child profile, you represent that you have legal authority to consent on behalf of that child.
• Accuracy: You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3. The Service

GoalQuest provides a goal-tracking and rewards platform designed for families:

• Goal Management: Parents can create goals for children with associated reward values.
• Progress Tracking: Children can mark goals as complete, subject to parent approval.
• Reward System: Completed goals earn stars that accumulate in the child's wallet.
• Gift Card Redemption: Stars can be redeemed for gift cards from various retailers.

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

4. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring appropriate use of the app by your children
• Supervising your children's use of the service
• Notifying us immediately of any unauthorized account access

We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. Wallet & Stars

• Earning Stars: Children earn stars by completing goals approved by their parent.
• Star Value: Stars are virtual tokens with no cash value and cannot be exchanged for currency. They represent a parent's commitment to reward their child, not stored funds.
• Non-Transferable: Stars cannot be transferred between accounts or users.
• Expiration: Stars do not expire while your account remains active.
• Account Closure: Upon account deletion, any remaining stars will be forfeited.
• No Refunds: Stars are non-refundable under any circumstances.

6. Gift Card Redemption

GoalQuest acts as a mediator for gift card purchases. When your child redeems stars, GoalQuest facilitates the purchase of gift cards based on the star balance available. The parent is responsible for the actual payment at the time of redemption.

• How It Works: When stars are redeemed, GoalQuest processes the gift card purchase on behalf of the parent using the parent's authorized payment method.
• Availability: Gift card options are subject to availability and may change without notice.
• Processing: Gift card orders are typically processed within 24-48 hours.
• Delivery: Digital gift cards are delivered to the parent's registered email address.
• Third-Party Terms: Redeemed gift cards are subject to the issuing retailer's terms and conditions.
• No Returns: Once a gift card is issued, it cannot be returned or exchanged for stars.
• Verification: We may require additional verification for large redemptions to prevent fraud.

7. User Conduct

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the service
• Create multiple accounts to abuse the reward system
• Provide false information during registration or use
• Share your account with others
• Attempt to manipulate the star system fraudulently
• Use automated systems to interact with the service

8. Intellectual Property

All content, features, and functionality of GoalQuest, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Jordan Saker or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the service without our express written permission.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The service will be uninterrupted or error-free
• Defects will be corrected
• The service is free of viruses or harmful components
• The results of using the service will meet your requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JORDAN SAKER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the service shall not exceed the amount you paid us, if any, in the twelve (12) months prior to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Jordan Saker and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of a third party
• Any content you provide through the service

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the service will immediately cease
• Any stars in your wallet will be forfeited
• We may delete your data in accordance with our Privacy Policy

You may also delete your account at any time through the app settings.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the service shall be resolved exclusively in the courts of Australia.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by email and/or through the app. Your continued use of the service after changes are posted constitutes your acceptance of the modified Terms.

We encourage you to review these Terms periodically for updates.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
